Supreme Court pulls up CBI, ED over delay in 2G probe

The Supreme Court on Monday (March 12) dealing with the alleged extra-judicial killings in Manipur directed National Human Rights Commission (NHRC) to complete investigation of the cases registered by it first and also told Special Investigation Team (SIT) to monitor the investigations by NHRC and submit the report on it under the Section 143 of CrPC.

The issue of FIPB clearance in the the Aircel-Maxis deal had surfaced during the probe into the 2G spectrum related cases.

A bench headed by Justice Arun Mishra slammed the agencies for not completing their probe in all 2G cases, saying "you can't keep the people of the country in the dark".

Mehta was appointed as per modified notification for the objective of "Appeals/revisions or other proceedings arising out of the cases related to 2G Spectrum". "Various orders had been passed by this court number of times. We are anxious about this case, we are very unhappy".




The AG said the Centre will file the status report as per the court's direction and if the bench wants, then it will file the document without sealed cover notwithstanding the relationship with Malayasia government.

Holding that the prosecution had "miserably failed to prove the charges beyond reasonable doubt", a special CBI court in last December had acquitted all 19 accused, including former telecom minister A Raja, DMK Rajya Sabha MP M Kanimozhi, top corporates and bureaucrats of corruption and money laundering charges in the 2G spectrum allocation case. The direction of the Supreme Court has come after Tushar Mehta appointed as the special public prosecutor in all 2G scam related cases. The agency had found that the approval given in the Aircel-Maxis deal was given by Chidambaram beyond his mandate. He is accused of giving Foreign investment Promotion Board (FIPB) green light in Aircel-Maxis case.

In a separate writ petition in the apex court, Mr. Chidambaram called the CBI and ED probe into the Aircel-Maxis case "illegal investigations".
