Should Kathua trial be sent to Chandigarh, SC asks J&K government

The Theresa May government on Monday reiterated Prime Minister Narendra Modi's promise that justice will be done in the rape and murder of an eight-year-old girl at Kathua in Jammu and Kashmir, when the matter was raised by a Pakistani-origin member of the House of Lords.

The court also issued notice to the state on a petition filed by the victim's father that says the atmosphere in Jammu is highly polarised for a fair trial and the accused must be tried in Chandigarh.

Senior lawyer Indira Jaising, appearing for the victim's father, told a Bench led by Chief Justice Dipak Misra that the state police had done a good job in carrying out a scientific investigation and arresting all the eight accused.

He said he was ashamed to see how the advocate for the Kathua victim's family was being threatened allegedly by other lawyers.

Adv Ashok Arora told KNS that the blocking of challan by the lawyers in Kathua amounts to contempt. "Authorities should take action against those lawyers who tried to prevent Crime Branch from filing the charge sheet", former Secretary SC Bar Association told KNS.

The alleged gangrape and murder of the eight-year-old girl, who belonged to the nomadic Muslim community, took place in the Kathua district in January. The protection of the victim's family and the lawyer, who pleads on their behalf, is of utmost importance.




Reports said students from various departments have assembled inside the campus, and students were seen holding placards in their hands, depicting different messages calling for justice in the case of Kathua rape and murder case.

CM Mehbooba Mufti's brother and Tourism Minister Tasaduq Mufti was quoted on April 13 as saying "we (PDP) have ended up being partners in a crime (with BJP) that an entire generation of Kashmiris might have to pay with their blood".

The top court directed the next hearing on April 27.

Immediately after the brief hearing in the sessions court, the seven accused were shifted back to jail under heavy security.

According to the police chargesheet, the minor girl was gangraped and drugged during her captivity at a temple in Rasana. A week later, her body was found in the same area, and medical examination pointed towards sexual assault and torture.
