Scheer and Federal Conservatives Support Ford's Use of Notwithstanding Clause

The city had challenged the province's initial council-cutting legislation in court and a Toronto judge ruled earlier this week that passing the bill in the middle of municipal election campaign violated the freedom of expression rights for voters and candidates.

Bailey said the government is also appealing the initial ruling to get the opinion of a higher court, but he suggests there's urgency in saving significant dollars in Toronto over the next four-year council term. The provincial government has appealed the ruling and reintroduced its changes this week in a new bill, compounding the chaos facing the clerk as she oversees preparation for the election.

Harrison says that Ford made a decision that he is well within the law to make.

Sources say the weekend sitting will allow the government to pass Bill 31, which will downsize Toronto council from 47 to 25 members, into law more quickly.

"We are the people", a man yelled, referring to the Ford government's slogan of government "for the people".

Scheer refused to speculate about whether he would use the notwithstanding clause if he forms government.




Ontario legislators "need to the voice of Ontarians on this, that this isn't the right way to go", she said in an interview.

"We have hit a tipping point", Watkiss told Toronto councillors at a special session.

Municipal Affairs Minister Steve Clark said he still believes the city can head to the polls as scheduled.

"Today we will be reintroducing a bill that will make the City of Toronto operate more efficiently for its citizens". He wouldn't say, however, if the province has a backup plan should Toronto's clerk find that the city can not be ready for the vote in time.

The Opposition NDP, Green and Liberal parties had asked Progressive Conservative MPPs to vote against the bill invoking the notwithstanding clause - but in a public vote, dissidence would have been surprising.

"On behalf of FCM's Big City Mayors' Caucus, I am offering full support to the City of Toronto's efforts to protect local democracy". The legislation has passed first reading and the Tory house leader has said it is expected to pass final reading on the week of September 24.
